· We do not pass on any of customers information to anyone else; we keep our customers personal details confidential and use them only for the purpose we got them for. We do not sell, or share customers personal details with other businesses or vendors. According to the Privacy Act 1993 you may check and correct the accuracy of personal details at any time.
· From time to time we may send you product information (including special offers) in the mail or by e-mail. If you wish to remove your name from our mailing list please ask us to do so or use “REMOVE ME” link in the email.
2. Use of Web-site & E-mails
· Waysoft Ltd. makes every effort to keep the information on this website current, accurate and complete. However, Waysoft Ltd. cannot guarantee that the information is accurate or complete or that it is current at all times. Waysoft Ltd. assumes no responsibility for any errors. Waysoft Ltd. reserves the right to change or modify information contained on the website at any time without notice.

· Reliance upon any information and material on this Site shall be at your sole risk. Our company accepts no liability for the content of this website, or for the consequences resulting from the use of, or reliance on, the information and materials contained on this website or on any third party website linked to it. All information should be verified independently before being used or relied on. Viewers are encouraged to contact Waysoft Ltd. to ensure the accuracy of the information.
· Waysoft Ltd. cannot and does not guarantee or warrant that files available for downloading through the site will be free of infection or viruses, worms, or other code that manifest contaminated or destructive properties. You are responsible for implementing sufficient procedures and check points to satisfy yourself as to the integrity of files downloaded from this site.
· The recipient of any of our e-mails should check the e-mail and any attachments for the presence of viruses. The company accepts no liability for any damage caused by any virus transmitted by company e-mails.
· If you wish to remove your name from our mailing list please ask us to do so or use “REMOVE ME” link in the email. Please note that this will not affect order confirmation emails, they will be sent to you every time you place an order.
3. Typographical Errors
If a product is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, we reserve the right to refuse or cancel any orders placed for product or service listed at the incorrect price. Waysoft Ltd. has the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, we will issue a credit or solve the problem in the way most suitable for you and our company.
4. Payments
- PAYMENTS BY CHEQUE
If this is your 1st - 5th order BY CHEQUE with us:
Your cheque for this order must be cleared before your order is dispatched.
If this is your 6th order or more BY CHEQUE with us:
Your cheque for the previous order must be cleared before the new order is dispatched.
Please allow 4-5 working days for cheques to be cleared. Please plan your payments and orders accordingly. We cannot send your order on the same day the cheque is received at our office; it must be cleared first, so please allow for this time.
- PAYMENTS BY BANK PAYMENT/DEPOSIT AND MONEY ORDER
If this is your 1st - 5th order BY BANK PAYMENT/DEPOSIT OR MONEY ORDER with us:
We need to receive the payment for this order before it can be dispatched.
If this is your 6th or more order BY BANK PAYMENT/DEPOSIT OR MONEY ORDER with us:
We need to receive the payment for your previous order before your current order can be dispatched (even if your current order is placed within 14-day period from your previous order).
Normally your bank payments and deposits will show on our account overnight. However it can take longer depending on your bank's processing times.
IMPORTANT! When making a bank payment it is important that you email us or call us with full information about the payment that you made. Due to the large number of transactions into our account it gets difficult sometimes to allocate payments to the right customer, resulting in delays in delivery or your account reconciliation, please ensure that you supply us with the following information immediately after making the payment:
1-Amount paid
2-Date paid
3-Internet Order number
4-Bank reference used (your account name).
This information will assist us in processing your order & payment promptly.
If you would like your order to be dispatched immediately (subject to our working hours), please choose Credit Card payment option.
5. Delivery
· Every effort will be made to fulfill orders placed with Diapers Express/Waysoft Ltd., but we shall not be liable to any person if Waysoft Ltd. declines to supply product(s) for any reason whatsoever. We reserve the right to decline orders without disclosing the reason behind that action.
· Waysoft Ltd. shall not be liable for failure to deliver on expected time whether the delay has been due to causes beyond the control of Waysoft or otherwise.
· Please note that CHOOSING A WRONG DELIVERY ZONE WILL RESULT IN THE ORDER TO BE PUT ON HOLD until the right courier fee is confirmed and accepted by you. This applies to customers who pay by bank payment, deposit, cheque or money order. For credit card orders WE RESERVE THE RIGHT TO CORRECT THE DELIVERY ZONE AND CHARGE YOU the right courier fee without prior confirmation. We are not liable for any losses or delays if we can’t reach you through the phone number or email address you provided when placing the order. So please for prompt delivery ensure that you pick the right delivery zone. If you are not sure about the charges or forgot to include them please contact us by phone or email as soon as possible to avoid delays in delivery.
· If the Customer fails to sign or did not request for signature to be obtained on delivery of the Products, the Products shall be left at the delivery address,where courier driver feels it was safe to drop, and be deemed delivered at that point in time. It is the customer's responsibility to give our company delivery instruction (like Signature required or Do not drop at front door etc), our General instructions to the courier drivers is to drop the boxes at the delivery address if no instructions were given by the customer to do otherwise. The property and risk in the Product shall pass to the Customer upon delivery to the Customer's delivery address, and when the courier company confirms that it has been delivered to the right address.
· In case of short or incorrect delivery you need to contact us as soon as possible. Any queries regarding delivery of parcels and the contents will not be considered after 14 days from dispatch date.
6. Returns, Refunds & Restocking Fee
· Any faults in any of our products must be reported within 14 days from the date of purchasing the goods. Waysoft Ltd.is not liable for any compensation or refund if the fault in any product is reported after 14 days from the date of purchasing the product.
· “Change of mind” returns will not be accepted, except for rare cases and solely to the discretion of Waysoft Ltd. In such rare cases Waysoft Ltd. reserves the right to charge a reasonable market rental for the period the item was used.
· Unused goods in original packaging may be retuned for exchange within the 14-day period from the purchase date, given that this has been confirmed with Waysoft Ltd. The invoice must be retained as a proof of purchase at all times.
· If unused product in its original packaging is returned after 14 days and before 3 months from the invoice date, 20% restocking fee will apply. Products can only be accepted if they have not been used and are still in their original packaging.
No product can be returned after 3 months from its purchase date (subject to warranty terms). It is your responsibility to contact us with any queries regarding any of our product within 14 days from the purchase date. If for some reason a customer returns a used product after 3 month Waysoft Ltd. reserves the right to charge the customer market value rental for the period that the product was used (product is considered to be in use starting from the purchase date).
· Customers are required to pay courier charges for the exchange (both to return to and send from us) when returning and/or exchanging wrong size products, unused product or for “change of mind” returns.
· When guaranteeing satisfaction with our products, Waysoft Ltd. is happy to refund the full amount for unopened packs of nappies and wipes (excluding Huggies products). Return courier fees are the responsibility of the Customer returning the product.
· When customers use more than 5 pcs of nappies, wipes or other disposable products from any box purchased, they acknowledge accepting the quality they have paid for. In this way the company fulfils the conditions of the term Quality guaranteed (or guaranteed quality, or satisfaction guaranteed or your money back....etc.) Customers may not ask for a refund or exchange after using more than 5 pcs, unless they pay for the used product and other incurred courier charges, as manufacturing faults can happen with any brand, even the top brands in the market. In rare instances of faulty product the company has the right to claim back any faulty goods from the manufacturer, therefore customers should not dispose of such faulty product without consulting the company first. Exchange of faulty product is only possible when the customer returns the faulty product. The company would (normally) reimburse the customer with more than the returned product for the factor of inconvenience. It is up to the company to decide if it does not want to have back the faulty product.
· If the customer received a free gift as a part of a promotion, the cost of the free gift will be deducted in case of refund or exchange if the free gift in its original condition and packaging is not returned along with the product it came with. Free gift cannot be returned for refund or exchanged and it has no cash value on its own.
· The liability of Waysoft for any loss, damage or injury arising directly or indirectly from one of our products or for the non-compliance of any of our products or for any other reason shall not in any event exceed an amount equivalent to the price of the product.
· Waysoft Ltd. has the right to change its policies relating to the return and refund of products at any time without notice.
7. Special conditions when buying clothing items online
PLEASE READ BEFORE ORDERING ANY CLOTHING ITEMS ONLINE.
Plenty of care has been taken before choosing a supplier for our infant clothing range, quality and modern designs were a priority when selecting clothes manufacturer. Due to the delicate nature of clothing products and for hygienic reasons the following conditions apply to all online purchases of such items, so please choose carefully before ordering:
o "Change of mind" returns will not be accepted. Please select the right size when ordering. The sizing scale we are using is a universal one, they are similar sizes used by other clothing outlets. Refer to the sizing chart for more information. Please use the chart as indication only and apply your own judgment if standard sizes do not suit your baby.
o Only unopened products in its original packaging and condition may be returned for exchange or credit and only at the discretion of Waysoft Ltd./BabyOnline.
o All exchanges or returns must be at customer's cost.

· All prices on the website are in NZ$ and inclusive of GST. Prices may change without prior notice.
· All quotes from Waysoft Ltd. are valid while stocks last unless stated otherwise. Specials are subject to availability and while stocks last.
